1. Acceptance of Termsโ
By accessing or using Supernal TTS ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
2. Description of Serviceโ
Supernal TTS provides a text-to-speech API that integrates with multiple TTS providers (OpenAI, Azure, Cartesia, etc.) and offers embeddable widgets for websites.
2.1 Service Componentsโ
- API: RESTful API for text-to-speech generation
- Widget: Embeddable JavaScript widget for websites
- Documentation: Guides, examples, and API reference
- Caching: Intelligent audio caching to reduce costs
- Self-Hosting: Open-source option to deploy your own instance
3. User Accountsโ
3.1 Account Creationโ
- You must provide accurate, complete information
- You are responsible for maintaining account security
- You must be at least 18 years old to create an account
- One person or entity may not maintain multiple free accounts
3.2 Account Securityโ
- Keep your API keys confidential
- Notify us immediately of any unauthorized access
- You are responsible for all activities under your account
- We reserve the right to suspend accounts showing suspicious activity
4. API Usageโ
4.1 API Keysโ
- API keys are personal and non-transferable
- Do not share API keys publicly (GitHub, forums, etc.)
- Rotate keys regularly for security
- Report compromised keys immediately
4.2 Usage Limitsโ
- Free tier: Subject to rate limits and quotas
- Paid tiers: Based on your subscription plan
- Excessive usage may result in throttling or suspension
- Enterprise plans available for high-volume usage
4.3 Acceptable Useโ
You agree NOT to use the Service to:
- Generate harmful, illegal, or abusive content
- Violate intellectual property rights
- Spam, phish, or distribute malware
- Impersonate others or misrepresent affiliation
- Bypass rate limits or security measures
- Resell the Service without authorization
- Generate content that violates third-party TOS (OpenAI, Azure, etc.)
4.4 Prohibited Contentโ
Do not submit text containing:
- Hate speech, harassment, or threats
- Sexually explicit or graphic content
- Personal information of others without consent
- Copyrighted material you don't have rights to use
- Misinformation or content designed to deceive
5. Bring Your Own Key (BYOK)โ
5.1 Third-Party Providersโ
When using your own API keys for OpenAI, Azure, or Cartesia:
- You are subject to their terms of service
- You are responsible for your usage and billing with them
- We act as a passthrough and are not liable for their service quality
- Costs are billed directly by the provider to you
5.2 Key Storageโ
- We encrypt your API keys at rest
- Keys are only used to make API calls on your behalf
- You can delete keys at any time
- We do not share keys with third parties (except the intended provider)
6. Billing and Paymentsโ
6.1 Pricingโ
- Free tier available with limitations
- Paid plans available for higher usage
- Pricing displayed on our website
- We reserve the right to change pricing with 30 days notice
6.2 Payment Termsโ
- Payments processed via Stripe or similar
- Subscription fees billed monthly or annually
- Usage-based fees billed monthly
- All fees are non-refundable unless required by law
6.3 Taxesโ
You are responsible for any applicable taxes (VAT, GST, sales tax) in your jurisdiction.
6.4 Late Paymentโ
- Accounts with overdue payments may be suspended
- We may charge interest on late payments
- Access restored upon payment
7. Intellectual Propertyโ
7.1 Our IPโ
- The Service, including software, documentation, and branding, is our property
- Open-source components are licensed separately (see LICENSE file)
- You receive a limited, non-exclusive license to use the Service
- You may not reverse engineer, decompile, or create derivative works
7.2 Your Contentโ
- You retain ownership of text you submit
- Generated audio is licensed to you for your use
- You grant us a license to cache and process your content to provide the Service
- We do not claim ownership of your generated audio
7.3 Widget Usageโ
- The embeddable widget is MIT licensed (see package LICENSE)
- You may use and modify the widget per the MIT license
- Attribution appreciated but not required
8. Data and Privacyโ
- We collect and process data as described in our Privacy Policy
- We implement reasonable security measures
- You are responsible for the content you submit
- We may use anonymized data for analytics and improvements
9. Service Availabilityโ
9.1 Uptimeโ
- We strive for high availability but provide no uptime guarantee
- Scheduled maintenance will be announced when possible
- We are not liable for downtime or service interruptions
9.2 Changes to Serviceโ
We reserve the right to:
- Modify or discontinue features with notice
- Update APIs (with deprecation period for breaking changes)
- Suspend Service for maintenance
10. Terminationโ
10.1 By Youโ
- You may cancel your account at any time
- Cancellation does not entitle you to refunds
- Cached data will be deleted per our retention policy
10.2 By Usโ
We may suspend or terminate your account for:
- Violation of these Terms
- Fraudulent activity or payment issues
- Inactivity (free accounts after 6 months)
- Legal or regulatory requirements
11. Disclaimersโ
11.1 Service Provided "As Is"โ
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- UNINTERRUPTED OR ERROR-FREE OPERATION
11.2 Third-Party Providersโ
We are not responsible for:
- Quality or availability of third-party TTS services
- Changes to third-party APIs or terms
- Costs incurred with third-party providers
11.3 Generated Contentโ
- We do not guarantee accuracy or quality of generated audio
- You are responsible for reviewing generated content
- We are not liable for how you use generated audio
12. Limitation of Liabilityโ
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS
- WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES
- THIS INCLUDES LOSS OF PROFITS, DATA, OR GOODWILL
Some jurisdictions do not allow limitations on liability, so these may not apply to you.
13. Indemnificationโ
You agree to indemnify and hold us harmless from claims arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of third-party rights
- Content you submit or generate
14. Dispute Resolutionโ
14.1 Governing Lawโ
These Terms are governed by the laws of Delaware, USA, without regard to conflict of law provisions.
14.2 Arbitrationโ
Any disputes shall be resolved through binding arbitration, except:
- Small claims court actions
- Injunctive or equitable relief
14.3 Class Action Waiverโ
You agree to bring claims individually, not as part of a class action.
15. General Provisionsโ
15.1 Entire Agreementโ
These Terms constitute the entire agreement between you and us regarding the Service.
15.2 Severabilityโ
If any provision is found invalid, the remaining provisions remain in effect.
15.3 Waiverโ
Failure to enforce a provision does not waive our right to enforce it later.
15.4 Assignmentโ
You may not assign these Terms. We may assign them without notice.
15.5 Force Majeureโ
We are not liable for delays or failures due to circumstances beyond our reasonable control.
